Florida PIP Guide
Updated 2026-10-29 · General information, not legal advice.
Florida is a no-fault state. Every owner of a four-wheel motor vehicle registered in Florida must carry Personal Injury Protection (PIP) of at least $10,000, under section 627.736 of the Florida Statutes. After a crash, your own PIP pays first, no matter who caused it.
What PIP pays
- Medical benefits: 80% of reasonable medical expenses, up to the policy limit.
- Lost wages: 60% of lost gross income.
- Death benefit: $5,000 per person, in addition to medical and disability benefits.
The 14-day rule
To use PIP medical benefits, you generally must receive initial treatment within 14 days of the crash from a qualified provider: a hospital or emergency department, a physician, a dentist, a chiropractor, or emergency transport. If you wait longer, the insurer can deny PIP medical benefits.
Emergency medical condition (EMC)
The full $10,000 is available only if a qualified medical provider determines you have an emergency medical condition. Without an EMC finding, medical benefits are limited to $2,500.
Stepping outside PIP
You can bring a claim against the at-fault driver for pain and suffering only if your injury meets Florida's threshold: significant and permanent loss of an important bodily function, permanent injury, significant and permanent scarring or disfigurement, or death. Economic losses PIP does not cover may also be claimed.
When PIP is denied or cut off
Insurers may deny benefits for late treatment, for missed independent medical examinations, or by disputing whether the treatment was necessary. Before a PIP lawsuit, Florida law generally requires a pre-suit demand letter. Keep copies of everything the insurer sends you.
