How to Get a Miami Crash Report

Updated 2026-10-29 · General information, not legal advice.

A crash report records the officer's observations: the parties, the vehicles, insurance information, a diagram, witness information and sometimes citations. Insurers and attorneys rely on it, so get a copy and check it carefully.

Who has your report

Depending on where the crash happened, the report may have been written by the Florida Highway Patrol (common on expressways and state highways), the Miami-Dade Sheriff's Office, or a city police department such as Miami, Miami Beach, Hialeah, Doral or Coral Gables. Ask the officer at the scene for the agency name and report number.

How to request it

Florida crash reports can generally be requested online through the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) crash report portal, or from the agency that wrote it. A small fee per report usually applies.

The 60-day rule

Under section 316.066 of the Florida Statutes, crash reports are confidential for 60 days after the report is filed. During that time they are available only to the people involved, their attorneys, their insurers and certain others, who may need to sign a sworn statement.

Check it for errors

  • Names, plate numbers and insurance policy numbers
  • The location, date and time
  • The description and diagram of how the crash happened
  • Witness information

If something is wrong, contact the reporting agency. Officers may add a supplemental report, but they rarely change their opinion of fault.

It often takes several days to a couple of weeks before a report is available.
